1. Acceptance of Terms

By downloading, accessing, or using the FitPay mobile application ("App") and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

2. Description of Service

FitPay is a lifestyle and productivity application designed to help users track fitness activity and visualize personal budgeting goals ("Services"). The App allows users to "unlock" pre-set budget amounts through physical activity, participate in social challenges ("Circles"), and interact with an AI-powered coach ("Tess").

3. Important Disclaimers

3.1 Medical Disclaimer (Read Carefully)

FitPay is not a medical device and does not provide medical advice. The exercises, workout plans, and AI coaching provided by the App are for informational and educational purposes only.

• Consult a Doctor: You should consult with your physician before beginning any new exercise program.
• Assumption of Risk: By using the App, you represent that you are in good health. You acknowledge that engaging in physical exercise involves inherent risks of injury. You agree that FitPay and its creators are not liable for any injuries or damages you may sustain while using the App.

3.2 Financial Disclaimer

FitPay is a tracking and visualization tool only.

• No Real Money Processing: The "Fun Money," "Budgets," and "Earnings" displayed in the App are virtual figures input by the user. FitPay does not process, hold, transfer, or manage real-world currency.
• Not a Bank: We are not a financial institution. The transparency features provided (sharing transaction logs with a partner) are for personal record-keeping only. FitPay is not responsible for any financial disputes, overdrafts, or relationship disagreements resulting from the use of these tracking features.

3.3 AI Disclaimer ("Tess")

The App includes an AI Coach features powered by large language models.

• Accuracy: Artificial Intelligence can occasionally generate incorrect or misleading information. You should verify any fitness or nutritional advice provided by the AI before acting on it.
• No Professional Relationship: Interaction with the AI does not create a doctor-patient or trainer-client relationship.

4. User Accounts and Security

To use certain features, you must register for an account. You agree to:

• Provide accurate and complete information.
• Maintain the confidentiality of your password.
• Accept responsibility for all activities that occur under your account.

5. Virtual Currency and "Sweat Points"

The App may include a virtual currency system known as "Sweat Points."

• No Cash Value: Sweat Points have no monetary value and cannot be exchanged for real money, goods, or services outside of the App.
• Challenges: "Winner Takes All" challenges involve wagering these virtual points only. This is not real-world gambling. FitPay reserves the right to modify or eliminate Sweat Points at any time without liability.

6. User Conduct and "Circles"

FitPay allows you to connect with friends and partners in "Circles." You agree not to use the App to:

• Harass, bully, or threaten other users.
• Post content that is hateful, violent, or sexually explicit.
• Manipulate data to cheat in challenges.

We reserve the right to terminate the account of any user who violates these guidelines.

7. Intellectual Property

The App, including its original content (excluding user-generated content), features, and functionality, is owned by King's Home Lab LLC and is protected by international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall FitPay, its affiliates, agents, directors, employees, or suppliers be liable for:

• Any indirect, punitive, incidental, special, consequential, or exemplary damages.
• Any injury, harm, or health issues resulting from the use of the App's workout suggestions.
• Any relationship conflicts or financial disputes arising from the use of the budget tracking features.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
